Seller's Property Condition Disclosure Form – with radon disclosure

Beginning August 1, 2025, ND law requires the seller to disclose in writing to the buyer any knowledge the seller has of radon concentrations in the property. The seller or seller’s agent must provide the buyer with a radon statement exactly as written in NDCC 47-10-02.2(2). The buyer must acknowledge receipt of this radon statement by signing a copy of the disclosure statement. The seller must provide the buyer a copy of radon test results reasonably available to or in the possession of the seller, and evidence of mitigation, before executing an agreement to sell or transfer the property.
ND law requires written property disclosure for the sale, exchange or purchase of real property if the real property is a residential dwelling with no more than 4 units located in North Dakota being sold or exchanged by the owner, and a real estate licensee with a real estate brokerage firm represents or assists a party to the transaction.
