Beginning August 1, 2019, ND law requires written property disclosure for the sale, exchange or purchase of real property if a licensee assists a party to the transaction and the real property is an owner-occupied primary residence in North Dakota being sold or exchanged by the owner.
The N.D. Real Estate Commission is required to make a disclosure form available, but the written disclosure does not need to be made using the form provided here.
Brokerage firms for both the seller and the buyer must keep a copy of the written disclosure completed and signed by the seller and signed by the prospective buyer. (NDCC 47-10-02.1)
